No wonder Dick Pratt and co intend to fight the cardboard box cartel allegations for as long and as hard and as far as possible – pleading guilty is proving extremely costly to Amcor as the customers keep knocking asking for refunds.
The Weekend Oz had an update on the first of Amcor’s big customers going the legal knuckle, Cadbury Schweppes seeking $120 million but that’s on top of a $300 million class action and ahead of further expected individual actions by other major customers.
All this of course begs several questions of Visy’s defence – you can’t have a cartel of one.
And there are other class actions in the offing, with Multiplex in the news over the shareholder case being touted by Maurice Blackburn Cashman, never mind what might eventually happen to AWB – if there is anything left of it to sue after the Americans get through with it.
But there are also mysteries about class actions that don’t happen. For example, Maurice Blackburn Cashman went public last year about getting up a possible class action against Woolworths and Coles over the NSW bottle shop racket – but that one has failed to proceed. Pity.
